Terms and Conditions

These Terms & Conditions apply to all model railroad equipment and model repair, maintenance,
installation, modification, troubleshooting, and related services provided by JR Hobbies
LLC (“Repairer”) to the customer (“Customer”).
By requesting or authorizing repair services, the Customer agrees to these Terms &
Conditions.

1 | Repair Authorization

The Customer authorizes the Repairer to inspect, diagnose, test, repair, maintain,
modify, or otherwise service the locomotive or other model railroad equipment identified on the applicable estimate, repair order, or invoice.
The Customer represents that they are the owner of the equipment or are authorized by the owner to request the work.
The Repairer may decline or discontinue work on any item if, in the Repairer’s judgment, the requested work is unsafe, impractical, uneconomical, beyond the Repairer’s capabilities, or likely to cause additional damage.

2 | Estimates and Additional Work

Repair estimates are based on the information reasonably available at the time the
estimate is prepared.
Because model railroad equipment may have hidden damage, previous modifications, worn components, missing parts, or other conditions that cannot be determined until the locomotive is opened and tested, the final cost may differ from the original estimate.
The Repairer will make reasonable efforts to contact the Customer before performing additional work that would materially increase the estimated cost.
Unless otherwise agreed in writing, approval for additional work may be provided by email, text message, phone conversation, Square authorization, or other documented communication.
If the Customer declines additional work, the Customer remains responsible for
reasonable diagnostic, inspection, disassembly, reassembly, testing, parts, and labor charges already incurred.

3 | Payment

Unless otherwise agreed in writing, payment is due when the repair is completed and the locomotive is ready for return to the Customer.
The Repairer may require a deposit or advance payment for:
● Special-order parts;
● High-value parts;
● Extensive repairs;
● Custom work;
● Repairs expected to require substantial labor; or
● Any other work where the Repairer determines that an advance payment is
appropriate.
The Repairer requires payment in full before returning the equipment to the Customer.
Accepted payment methods are those made available by the Repairer, including cash, Venmo, CashApp, PayPal, or payment through Square Card Reader, or other payment methods designated by the Repairer.

4 | Retention of Customer Property for Nonpayment

The Customer acknowledges that the Repairer may retain possession of the locomotive or other equipment until all amounts properly due for authorized repair services, parts, and other applicable charges have been paid.
For property located in Iowa, this provision is intended to preserve the Repairer’s rights under applicable Iowa law, including Iowa Code Chapter 577 concerning artisan’s liens.
The Repairer does not automatically become the owner of a locomotive merely
because an invoice remains unpaid.
The Customer remains the owner unless ownership is otherwise transferred by a valid written agreement or through a lawful disposition process.

5 | Unpaid or Unclaimed Equipment

If the Customer does not pay the completed invoice or make reasonable arrangements for payment and pickup, the Repairer may contact the Customer using the contact information provided with the repair order.
The Repairer may provide written notices concerning the unpaid balance and the
Customer’s obligation to retrieve the equipment.
If equipment remains unpaid and unclaimed, the Repairer may exercise any lien,
collection, or disposition rights available under applicable law.
The Repairer will not treat a locomotive as automatically abandoned or
automatically become its owner solely because a specified number of days has
passed.
Any sale, transfer, or other disposition of unpaid or unclaimed equipment will be
conducted only as permitted by applicable law.
The Customer remains responsible for any unpaid balance to the extent permitted by law.

6 | Storage

Once a repair has been completed and the Customer has been notified that the
equipment is ready for pickup, the Customer is expected to arrange prompt payment and pickup.
If the Repairer establishes a storage charge, the applicable rate will be disclosed to the Customer before the charge begins whenever reasonably practicable.
Storage charges, if applicable, will not eliminate or replace the Customer’s responsibility for the underlying repair invoice.
The Repairer reserves the right to decline future work for customers whose equipment remains unpaid or unclaimed.

7 | Parts

Parts installed during a repair become part of the repaired locomotive unless otherwise agreed.
The Repairer may use new, used, refurbished, reproduction, aftermarket, or salvaged components when appropriate, provided the type of component is disclosed or reasonably understood from the estimate or repair order.
Special-order parts may be non-returnable. The Customer may be responsible for the cost of parts ordered specifically for the Customer’s locomotive even if the Customer later declines to complete the repair.
Unless otherwise agreed, replaced parts may be retained by the Repairer for disposal, recycling, warranty return, or other legitimate business purposes. If the Customer wants replaced parts returned, the Customer must request them before the locomotive is released.

8 | Condition of Equipment

The Customer acknowledges that model railroad locomotives and related equipment
may be delicate, aged, previously repaired, modified, weathered, painted, digitally
equipped, or otherwise subject to deterioration.
The Repairer will use reasonable care when handling Customer property.
The Repairer is not responsible for pre-existing defects, hidden damage, brittle or
deteriorated components, prior improper repairs, undocumented modifications,
manufacturing defects, or failures unrelated to the authorized repair.
The Repairer will make reasonable efforts to identify significant pre-existing problems discovered during inspection and may document the condition with photographs.

9 | Testing and Operation

The Customer authorizes reasonable testing and operation of the locomotive as
necessary to diagnose, repair, program, calibrate, or verify the requested work.
Testing may include operation on a test track, programming equipment, electrical testing equipment, or other appropriate equipment.
The Repairer will use reasonable care during testing but cannot guarantee that an aged or previously damaged locomotive will tolerate all testing or operation without revealing additional defects.

10 | Repair Warranty

Unless otherwise stated on the applicable invoice or estimate, the Repairer warrants only that authorized labor will be performed in a reasonably workmanlike manner.
Any specific warranty period or warranty on parts will be stated on the applicable invoice
or estimate.
A warranty does not cover:
● New failures unrelated to the original repair;
● Customer damage;
● Abuse, misuse, derailments, crashes, or electrical damage;
● Unauthorized modifications;
● Normal wear and tear;
● Failure of unrelated components;
● Problems caused by track, power supply, decoder programming, or other
equipment outside the Repairer’s control; or
● Parts or components that fail independently of the repair performed.
Warranty claims must be brought to the Repairer’s attention within the applicable
warranty period.

11 | Risk of Loss

The Repairer will exercise reasonable care while Customer property is in its possession.
However, the Customer acknowledges that model railroad equipment may be fragile and may contain valuable, discontinued, or irreplaceable components.
The Repairer is not responsible for loss or damage caused by circumstances beyond the Repairer’s reasonable control.
Nothing in these Terms & Conditions is intended to waive rights or protections that cannot legally be waived.

12 | Customer Information

The Customer is responsible for providing accurate contact information, including name, mailing address, email address, and telephone number.
The Customer should promptly notify the Repairer of any change in contact information while a locomotive or other property remains in the Repairer’s possession.
The Repairer may use the provided contact information for repair communications, estimates, invoices, payment notices, and pickup or disposition notices.

13 | Shipping

If equipment is shipped to or from the Repairer, the Customer is responsible for properly packaging the equipment unless the Repairer has agreed to provide packaging services.
The Repairer is not responsible for damage caused by inadequate packaging supplied by the Customer or by a shipping carrier.
When the Repairer ships equipment to the Customer, shipping charges and any agreed insurance or special handling charges are the Customer’s responsibility unless otherwise stated.

14 | Customer-Provided Parts

The Repairer may, at its discretion, install customer-provided parts.
The Repairer does not warrant the quality, compatibility, authenticity, condition, or expected service life of customer-provided parts.
If a customer-provided part is defective, incompatible, damaged, incomplete, or
otherwise unsuitable, the Customer remains responsible for labor and other charges already incurred.

15 | Photographs and Documentation

The Repairer may photograph or otherwise document Customer equipment for
purposes of inspection, repair records, condition documentation, warranty claims, and protection against disputes concerning the condition of the equipment.
The Repairer will not publicly display identifying customer information without
permission.

16 | Cancellation

The Customer may request cancellation of a repair at any time.
If work has already begun, the Customer is responsible for labor, diagnostic time, parts, shipping, special-order items, and other reasonable costs already incurred.
If the locomotive has been partially disassembled, the Repairer may require payment of applicable charges before returning the equipment.

17 | No Guarantee of Successful Repair

Some model railroad equipment may be beyond economical repair or may have multiple unrelated failures.
Unless specifically guaranteed in writing, the Repairer does not guarantee that a repair will restore an item to factory-new condition or that a particular performance result will be achieved.
If the Repairer determines that further repair is not reasonably practical, the Customer will be notified and will remain responsible for charges already incurred.

18 | Disputes

The Customer agrees to first contact the Repairer and make a reasonable attempt to resolve any billing, repair, or warranty dispute directly.
Nothing in these Terms & Conditions prevents either party from exercising rights
available under applicable law.

19 | Governing Law

For services performed in Iowa, these Terms & Conditions will be interpreted under the laws of the State of Iowa, except to the extent applicable law requires otherwise.

20 | Entire Agreement

These Terms & Conditions, together with the applicable estimate, repair order, invoice, and any written modifications agreed to by the parties, constitute the agreement concerning the repair services.
If there is a conflict between these Terms & Conditions and a specific written agreement for a particular repair, the specific written agreement will control to the extent of the conflict.

CUSTOMER ACKNOWLEDGMENT

By approving an estimate, authorizing repair work, submitting equipment for repair, or otherwise requesting repair services, the Customer acknowledges that they have had an opportunity to review these Terms & Conditions and agree to them.
